Airlines will have to pay compensation to passengers who experience delays of more than three hours following a law from the European Court of Justice (ECJ) on 19th November 2009. Passengers on cancelled flights can seek as much as €600 ($898). Airlines will only be exempt from paying compensation if they can prove that the delay was due to exceptional circumstances outside the airline’s control.
The court stressed that a technical problem cannot be considered as an exceptional circumstance unless it followed an incident connected with the normal running of the airline. Both Germany and Austria had sought clarification of the application EU legislation before reaching a judgment on passengers seeking compensation from Condor and Air France when their flights were delayed by 22 hours and 25 hours respectively.
